Layby Terms & Conditions

At Music Specialists, we offer a layby in store and online to make purchasing your desired musical instruments and accessories more affordable and convenient. Below are the terms and conditions for our layby service, in accordance with Australian Consumer Law (ACL):

1. Minimum Purchase Amount

A minimum purchase amount of $50 applies to use our layby facility.

2. Deposit

A deposit of 10% is required to initiate a layby. This deposit secures your items and counts toward the total payment.

3. Payment Terms

  • Payments can be made weekly, fortnightly, or monthly, as agreed upon at the time of setting up the layby.
  • The full balance must be paid within 3 months.
  • Online layby payments are facilitated by PayPal.
  • Instore layby payments can be made in person or over the phone. 

4. Layby Agreement

When you choose the layby option, you will be provided with a layby agreement that outlines all terms, including:

  • The total price of the items.
  • The deposit amount.
  • The payment schedule.
  • Any cancellation or termination fees.

5. Cancellation or Termination

  • By the Customer: If you choose to cancel your layby, any payments made will be refunded, minus a cancellation fee of the original 10% deposit to cover reasonable costs and restocking fees.
  • By the Store: If the layby is cancelled due to non-payment or failure to meet the agreed terms, we will refund all payments made, minus any applicable fees.
  • No Fees for Faulty Goods: If a product on layby is faulty or not as described, you are entitled to a full refund with no cancellation fees.

6. Changes to Layby Agreements

If any changes to your layby agreement are required (e.g., adjustments to the payment schedule), please contact us immediately to discuss your options.

7. Collection of Goods

Once full payment has been made, your items will be ready for collection. If the layby has been made online, shipping will have already been factored into the layby total. No additional costs should be applied at the finalisation of the layby, unless circumstances arise such as moving locations that are some distance from the address listed at the commencement of the layby. These fees may be applied if there is a difference in shipping costs. 

8. Your Rights Under Australian Consumer Law

This layby policy complies with the Australian Consumer Law. You are entitled to consumer guarantees, including the right to goods that are of acceptable quality, fit for their intended purpose, and match their description.
